Terms and conditions

This agreement, including the terms of use (“the Agreement”), applies between Zample AB, company registration number 559563-6357, Själagårdsgatan 9, 111 31 Stockholm (“Zample”) and you as the account holder (“the Account Holder”) of zample™ (“the Service”). “The Parties” refers to Zample and the Account Holder.

By registering an account and/or using the Service, you accept the Agreement. The Agreement is considered concluded when you have registered an account or logged into the Service via any of the available login methods.

1. General

1.1 Purpose of the Service

zample™ is a digital platform that enables account management and access to functions related to digital healthcare services, such as viewing test results and communication between Account Holders and connected healthcare providers. The Service is provided via the web application zample™ at app.zample.com and www.zample.com.

Zample may also enable the Account Holder to connect with affiliated healthcare providers within the Service, for example through offers of digital consultations, treatments, or other health-related services.

Zample does not provide healthcare services under these terms of use. Medical services, assessments, and care interventions are provided by the respective affiliated healthcare provider in accordance with their own terms and procedures.

1.2 Use of the account

The Account Holder may use the account to access information made available in the Service from one or more affiliated healthcare providers, such as test results, findings, and related information. In some cases, the Account Holder may also access comments or statements from qualified professionals at the respective affiliated healthcare provider. Each affiliated healthcare provider is responsible for its content and its processing of personal data in accordance with its own terms and privacy policy.

1.3 Contact details

The Account Holder is responsible for ensuring that the provided contact details are correct and kept up to date. Any changes must be made in the Service or communicated to [email protected] without delay.

1.4 Information in the Service

Terms, instructions, policies, and other relevant information may be made available in the Service to enable the Account Holder to easily access and stay updated.

2. Account, age, and use

2.1 Registration and age

To register and use an account, the user must either have valid electronic identification or provide a valid email address.

The Service is only available to individuals who are at least 18 years old.

By registering an account or using the Service, you confirm that you are at least 18 years old.

Please note that affiliated healthcare providers may have additional requirements for their services, and access to such services may be limited within the Service.

2.2 Account security and responsibility

The Account Holder is responsible for all actions carried out through the account and may not transfer or grant access to the account to any other person. The Account Holder is responsible for ensuring that the account is used properly and in accordance with the Agreement and applicable law.

2.3 Accuracy of information

The Account Holder is responsible for the information that the Account Holder enters or uploads into the Service.

2.4 Technical requirements

By using the Service, the Account Holder accepts the technical specifications, conditions, and limitations that apply to the Service and are presented within the Service.

2.5 Communication and marketing

Zample may send service-related communications necessary for the account and the platform’s functionality, such as verification codes, security messages, important operational information, and notifications about events in the Service (e.g., new messages, updates in a case, or information required for you to use the account).

Marketing communications are only sent if the Account Holder has actively opted in within the Service. Such choices can be made separately for different senders (e.g., Zample and/or affiliated healthcare providers). The Account Holder may change or withdraw these choices at any time within the Service and/or via the unsubscribe link in communications.

2.6 Information in the Service – not emergency care

The Service is intended as a digital support tool and never replaces emergency or traditional healthcare. In case of urgent medical issues, the Account Holder should contact the local emergency number (e.g., 112 within the EU) or another relevant healthcare provider.

2.7 Questions about how results are displayed

The Service may display test results, reference ranges, trends/graphs, and other health-related information in a specific way and may provide documents (e.g., PDF reports) from affiliated healthcare providers. For questions about how information is presented in the Service, contact [email protected]. For questions regarding the content of a medical report or your care, please contact the affiliated healthcare provider.

3. Pricing and payment

3.1 Free platform

Use of the Service is generally free of charge for Account Holders.

3.2 Payment for services from affiliated healthcare providers

Any payments for services purchased from affiliated healthcare providers are handled according to the respective provider’s terms of purchase and payment processes.

4. Zample’s responsibility

4.1 Platform responsibility

Zample is responsible for providing the technical platform and ensuring that the Service generally functions in accordance with the Agreement, subject to planned maintenance and service disruptions.

4.2 Medical responsibility and healthcare content

Medical services, assessments, sampling, referrals, test results, and medical records are provided by the respective affiliated healthcare provider in accordance with their terms and privacy policy. Zample is not responsible for medical assessments or healthcare content provided by affiliated healthcare providers.

4.3 Availability

Zample strives to ensure that the Service is available 24/7 but may need to carry out maintenance or manage service interruptions.

4.4 Limitation of liability

Zample is not responsible for interruptions or damages caused by:

  • the Account Holder’s equipment/network,
  • third-party services,
  • viruses/security breaches that cannot reasonably be prevented,
  • force majeure.

5. Intellectual property rights

Zample owns or holds the necessary rights to the Service. The Account Holder may use the Service in accordance with the Agreement but may not copy, decompile, or otherwise attempt to recreate the Service or its content beyond their own data where permitted.

6. Unauthorized use and suspension

6.1 Unauthorized use

Unauthorized use of the Service is prohibited. Unauthorized use includes, but is not limited to:

  • providing incorrect or misleading information
  • misusing the Service’s functions or processes
  • attempting to circumvent terms, payment flows, or decisions
  • acting in a threatening, harassing, or otherwise inappropriate manner when interacting with customer support

Such use may lead to immediate measures as described below.

6.2 Suspension

Zample reserves the right, with immediate effect, to temporarily or permanently suspend or terminate an account if:

  • the Account Holder materially breaches these terms
  • the Service is used in a way that is considered misuse
  • the Account Holder attempts to obtain unauthorized benefits, compensation, or refunds in violation of applicable terms
  • the Account Holder’s actions pose a risk to the Service’s operation, security, or personnel

Suspension may occur without prior notice where Zample deems it necessary.

Decisions regarding suspension are made solely by Zample without an obligation to provide detailed justification and may include restricting access to the account and its functions.

7. Personal data and privacy

Zample AB’s processing of personal data related to the account and platform is described in Zample AB’s privacy policy (platform) within the Service.

Processing of personal data related to care/medical records/referrals/test results is described in the affiliated healthcare provider’s privacy policy.

The Service is not offered to individuals with protected personal data (e.g., confidentiality markings, protected registration, or fictitious personal data). If you have protected personal data, you should not create an account or use the Service.

8. Term and termination

The Agreement applies until further notice from the time the account is registered. The Account Holder may request termination of the account at any time via the Service or by contacting support.

Please note that the responsible healthcare provider may be required by law to retain medical records even if the Account Holder closes their account. See the respective provider’s privacy policy for more information.

9. Changes to the Service and the terms

Zample may develop the Service and amend the terms. In case of significant changes, we will inform you appropriately within the Service. If the Account Holder does not accept the changes, the Account Holder may terminate the account.

10. Force majeure

Zample is not responsible for failure or delay in fulfilling its obligations under this Agreement if such failure is due to circumstances beyond Zample’s reasonable control (force majeure).

Force majeure includes, but is not limited to, war, acts of war, government actions, changes in legislation, labor disputes, blockades, fire, floods, natural disasters, pandemics, disruptions in electricity or telecommunications, interruptions in internet infrastructure, or other similar events.

In the event of force majeure, Zample has the right to postpone the fulfillment of its obligations for as long as the impediment persists. If the impediment continues for an extended period, Zample has the right to terminate the Agreement with immediate effect without liability for compensation.

Zample shall take reasonable measures to limit the effects of such events.

12. Assignment

Zample may engage subcontractors for operation and development. Zample may also assign the Agreement in connection with a transfer of business.

13. Disputes and applicable law

Swedish law shall apply to this Agreement. This does not affect any mandatory rights that the Account Holder may have under consumer protection laws in the country where the Account Holder resides. Disputes shall be settled in the first instance by the Stockholm District Court, unless otherwise required by mandatory law.
